Terms of Service

Welcome to StayHereMate. These Terms of Service ("Terms") govern your access to and use of the StayHereMate website, platform, and services operated by StayHereMate Pty Ltd ("StayHereMate", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our services.

You must be at least 18 years of age to use our services. By using StayHereMate, you represent and warrant that you meet this age requirement.

2. User Accounts

To access certain features of our platform, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorised access

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive behaviour.

3. Booking Terms

StayHereMate facilitates direct bookings between guests and property managers. When you make a booking through our platform:

• You enter into a direct agreement with the property manager
• You agree to the property's specific terms, house rules, and cancellation policy
• You are responsible for providing accurate booking details including dates, number of guests, and contact information
• StayHereMate acts as an intermediary and is not a party to the booking agreement

4. Payment Terms

StayHereMate charges zero booking fees to guests. The price displayed on a property listing is the total price you pay to the property manager (unless additional fees such as cleaning fees or bond are specified on the listing).

For property managers, we charge a flat monthly subscription fee as outlined on our Pricing page. Subscription fees are billed in advance and are non-refundable except as required by Australian Consumer Law.

5. Cancellation Policy

Cancellation policies are set by individual property managers and are displayed on each property listing. You should review the cancellation policy before making a booking.

StayHereMate is not responsible for refunds related to cancellations. Refund requests should be directed to the property manager in accordance with their stated cancellation policy.

6. Property Listings

Property managers who list on StayHereMate agree to:

• Provide accurate and truthful property descriptions and photographs
• Keep availability calendars up to date
• Respond to booking inquiries in a timely manner
• Comply with all applicable local laws, regulations, and safety standards
• Maintain appropriate insurance coverage for their properties
• Not list properties that they do not have the legal right to rent

7. Reviews

Users may leave reviews after completing a stay. Reviews must be honest, accurate, and based on genuine experiences. We reserve the right to remove reviews that:

• Contain offensive, discriminatory, or defamatory content
• Are fraudulent or not based on a genuine stay
• Include personal information of others
• Violate any applicable laws

8. Limitation of Liability

StayHereMate provides a platform for connecting guests with property managers. To the maximum extent permitted by law:

• We do not own, manage, or control any listed properties
• We are not responsible for the condition, safety, or legality of listed properties
• We are not liable for any disputes between guests and property managers
• Our liability is limited to the amount you have paid to StayHereMate in the 12 months preceding the claim

Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law that cannot be excluded or limited.

9. Intellectual Property

All content on StayHereMate, including text, graphics, logos, and software, is the property of StayHereMate Pty Ltd or its licensors and is protected by Australian and international copyright laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of material changes via email or through our platform. Continued use of StayHereMate after changes are posted constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
